joey barton




Joey Barton has come a long way. Where once he used to kick out at the world, frothing with bilious, toxic rage; thrashing the living shit out of teenagers outside McDonalds at three in the morning and using people’s aqueous humour to stub out his cigars, now he actively looks at paintings and books, each time memorizing their titles, and wears scarves indoor and out – even on the mildest of days.

Following his little red card wobbly against Manchester City (for which, coincidentally, he is now staring down the barrel of a reported ten – ten – game ban), Barton came in line for a bit of innoucuous criticism from Alan Shearer on Match of the Day.

Shearer’s scathing, vitriolic indictment saw him chastising Barton relentlessly, howling that there was “no need for his actions”, bad credit loans frothing that his conduct was “sheer madness” – and then came the curtain closer, the final act, the silver bullet through the brain in terms of character assassination: “We’ve seen it before and we’ll see it again. That’s what you get with Joey. He’s never going to calm down unfortunately.”

Later that eve, MotD host Gary Lineker took the issue of Shearer’s monstrous assault up with Barton on Twitter, to which he replied: “Just don’t like how he gets personal…” (note this down in your copy books, this will be a recurring theme from here on out.)

Wentz likes to wash me down with a crisp Sauvignon Blanc from Decibel Wines in New Zealand.

Madrid became ready to bring in a new set of superstars in Kaka, Cristiano Ronaldo and others. Robben was forced to leave as Real needed the money and space on the pitch. bad teacher review

PLOT: Elizabeth Halsey (Cameron Diaz) is a bad teacher. After only teaching for a year, Elizabeth thinks she’s on easy street when she bags a rich fiancĂ©e. Once she gets unsecured loans dumped, she’s forced to return to the job she hates, but things start to look up when Scott Delacorte (Justin Timberlake), a rich, handsome substitute, begins teaching at the school. However, Elizabeth has competition for Scott affections from the manic Amy Squirrel (Lucy Punch) a relentlessly chipper science teacher, with an axe to grind against slacker Elizabeth.


REVIEW: Black comedy is tough to pull off. For every HEATHERS or BAD SANTA, there’s a million DEATH TO SMOOCHYs. There seems to be a fine line between what’s acceptable, and what’s not, and in that regard, BAD TEACHER plays it safe. While it’s certainly a change of pace seeing Cameron Diaz in a raunchy R-rated comedy, BAD TEACHER is not a particularly dark ride. Her character, Elizabeth is not so much BAD in the BAD SANTA or BAD LIEUTENANT way, and they might have been better off calling this BITCHY TEACHER as that’s all she really is.



Her character’s not particularly cruel or devious. She’s just a slacker who shirks hard-work and responsibility, opting to go through life coasting on her good looks. Admirable? Hardly. Funny? Yeah, for the most part.

 
I’m a big fan of director Jake Kasdan, with him having directed several underrated gems including THE TV SET and WALK HARD, in addition to directing several classic episodes of FREAKS & GEEKS (from which, in addition to co-star Jason Segel, there are a few fun cameos). For the first forty minutes of so, BAD TEACHER is great. Diaz seems to be having the time of her life dropping F-bombs, making fun of overly enthusiastic students, and sneaking into the high-school gymnasium to get high with cynical gym teacher Jason Segel.

Diaz gets a lot of flak for having appeared in a slew of not-so-great films over the last few years, but as shown by her turn in THERE’S SOMETHING ABOUT MARY, and now this, she’s a natural at comedy. While still sexy, Diaz has always had a certain down-to-earth appeal that makes her seem somewhat more attainable than some of the colder on-screen beauties, and it’s this appeal that makes her believable, and funny in BAD TEACHER.

It helps that she’s got a dynamite supporting cast, led by Jason Segel, who’s doing a great job establishing himself as a leading man in the Bill Murray model. While the nice-guy gym teacher with a crush on the leading lady part might have been two-dimensional is other films, Segel’s so charismatic that he’s believable as a potential partner for Diaz. bad credit loans



As for Justin Timberlake, you gotta hand it to the guy- he knows how to be funny. That should be clear to anyone who’s seen him own on SNL over the last few years. His Scott Delacorte is a pretty amusing character, although, to be sure, it’s a one-note part, with his faux-dweeby shtick getting a little tiresome as the film wears on. The same goes for Lucy Punch as Diaz’ near-psychotic nemesis, who’s initially hilarious, but way overboard towards the end. Both characters are caricatures, but then again, not every film can be BRIDESMAIDS with its sharply defined, three-dimensional parts.

 
The problems in BAD TEACHER strike about forty minutes in, when the premise starts to run out of steam, with it seeming like they filmmakers didn’t exactly know where to go after hitting the halfway point. A side-plot about Diaz stealing a standardized test from Thomas Lennon’s nerdy school board examiner feels a little desperate, and sets the film on a more caper-ish course that’s a little disappointing.

However, warts and all, BAD TEACHER is still a pretty funny film, and one I had a good time with. Diaz and Segel are great, as are MODERN FAMILY’s Eric Stonestreet as Diaz’s goofy roommate, and THE OFFICE’s Phyllis Smith as a good natured teacher that befriends Diaz. While it’s inconsistent, the first forty minutes are enough to make it better than most comedies I’ve seen lately, and worth checking out.

Eden Project investment


The Eden Project has bid to be the home of a £3 billion investment bank that the Government hopes will underpin a green energy revolution.

Ministers have also received a submission from Torbay, meaning two Westcountry areas are among 32 locations looking to host the new Green Investment Bank.
While neither Cornwall nor Devon is considered a major financial centre, both bids are playing on the region’s green credentials, low costs and enviable quality of life.
Each points to the success of the Met Office re-locating to Exeter in 2003 as evidence of high-calibre staff settling in the far South West.

The Cornwall bid, backed by Eden bosses and the county’s council and development company, emphasises the symbolism of the bank’s offices sitting alongside the iconic biomes.
Its proposal states: “The first investment the Green Investment Bank will make is in choosing its own location. Wouldn’t it make sense if that investment, that location, symbolises everything the Green Investment Bank is designed to achieve?”

Torbay, dubbed the English Riviera, intends to base the bank’s headquarters on the edge of Torquay.
“The South West is at the heart of the UK’s green economy,” its submission, penned by the Torbay Development Agency, outlines. “And Torbay is centrally placed to take advantage of this.”
The Government has repeatedly hailed the potential for wind, wave, geothermal and solar technology in the South West.

Last month, ministers announced the region is to be the UK’s first Marine Energy Park, paving the way for jobs-boosting investment in wave and tidal power.

Kevin Lavery, chief executive of Cornwall Council, told the Western Morning News: “It is a bit of a long shot as we do not have a major financial sector like a Leeds or a Manchester. But where better to base a financial institution for green energy than the Eden Project?”

Adrian Sanders, Liberal Democrat MP for Torbay, said: “I am fully behind it. We are extremely well-placed in a number of ways.”

The bank would bring more than 100 jobs to whichever area is selected, and would lend an area added kudos for being home to the first bank of its kind in the world.

By putting forward £3 billion of state money as a stake, the Government aims to generate an extra £15 billion of private investment by 2015.

The bank should have powers to borrow, issue bonds to institutional investors and raise cash from the public through the sale of “green ISAs”, commentators have said.

Both bids underplay the region’s modest banking reputation and that they are locations physically remote from the City of London.

Both Eden and Torbay, which would base the bank at Edginswell business park in Torquay, point out there are few regions to rival the Westcountry on green power. unsecured loans

University campuses in Plymouth, Exeter and Penryn, near Falmouth, boast world-leading renewables academics and the Wave Hub off the North Cornwall coast is poised to be the world’s largest wave energy berth. Those behind Cornwall’s bid believe being based at Eden, which has proposed a geothermal “hot rocks” plant and is globally recognised thanks to attracting millions of visitors to the former clay mines, is a trump card.

“The location will make the bank internationally famous from day one,” it states.
Other areas to have expressed an interest in hosting the headquarters include Liverpool, Leeds, Gloucester and Bristol.

Business Secretary Vince Cable will announce his final decision on siting the HQ this month.

Viddy


Facebook CEO Mark Zuckerberg has made his mark on the fast-growing video sharing startup Viddy, after signing up for the service and sharing a video of his dog. The move has tech watchers eyeing many comparisons to Viddy and just-purchased Instagram.

After launching its own Facebook Timeline app, social video sharing startup unsecured loans Viddy began to grow at a startling fast rate, eventually adding 5.5 million users in 11 days. Viddy’s successful tie-in to Timeline has prompted other services to launch Timeline apps, including Magisto and Ustream. Zuckerberg’s first and only post on Viddy is a 15-second clip of his dog Beast playing. It’s not a terribly surprising or exciting video, but when the CEO of one of the hottest companies on the planet posts a clip, people take notice. And hey, who doesn’t like cute animal videos?

Viddy is rumored to be raising a new $30 million round at a potential $300 million valuation. Burning a series to DVD


Actually the full title of this article should be "how to put many movies or episodes in one DVD and when you shouldn't" ! I frequently receive emails from users that want to add many movies or a whole season of some series in one DVD. In this article I will try to explain what impact this would have to the quality (with video samples to see for yourself) of the DVD you will create and finally show you how you can create such a DVD using FAVC.

The DVD-Video Standard

The standard that all DVD-Video discs have to follow in order to be compatible with any player out there uses MPEG2 compression up to 9800kbps or in some rare cases MPEG1 up to 1856kbps. As you can understand, the mandatory use of the MPEG2 codec is our main limitation. The DVD format was finalized back in 1996, so they used what was then a cutting-edge compression technology. Unfortunately, as the years passed and new codecs like DivX/XviD or H.264 came out (MPEG4 if you want) with much greater picture quality in reduced sizes, for a DVD disc we still need to use the MPEG2 codec. The audio in the other hand, can be AC3, DTS or MP2 in multichannel setups, and we can have up to 32 subtitle tracks.

What retail DVDs use

Most DVDs in the market use a variable bitrate video of approximately 5000kbps video which is increased close to 8000kbps in high action scenes, which require more attention. Most of the times, the media used is DVD9 (7.95GB) in which they fit the movie, various audio tracks, menus and all extras. They rarely use DVD5 (4.38GB).

What happens in lower bitrate

As you understand, the lower the bitrate is, the most video a DVD can hold. However, since MPEG2 is an old codec, unlike H.264 which can achieve great results in low bitrate, anything under 3000kbps gives a very poor result which a significant amount of artifacts. Below I have created a small table which various bitrates, the approximate length of a video you could fit in a DVD (with a low quality AC3 audio in 128kbps in consideration) and an one minute sample from a movie using two free MPEG2 encoders to see for yourself the difference in quality. You can play the samples using the Open Folder option in VLC or with any other player of your choice.

What does this mean in practice

It depends on two things: the movie itself and the devices you will use for playback. Let me elaborate: if your movie contains many action scenes, explosions, fast chases etc or is shot mainly in dark (night) it will not look good if you lower the bitrate too much. In the other hand, a comedy or some sitcom will look better as the video is less demanding. If there is no need I wouldn't encode any DVD under 1500kbps. The action ones even higher.
Now the playback equipment is another parameter. For a handheld player (those with that small screens) or a SDTV (the old CRT ones) you will be fine. But if you are planning to use a HDTV (even in low resolution of an old DVD player) I suggest you don't squeeze too much video. For playback on a PC I don't even suggest a DVD-Video. Just convert to H.264 and burn a data DVD. Of course for a HDTV and an upscaling DVD player just encode one movie per DVD for maximum quality, you don't need me to tell you that.
Bottom line, I suggest putting up to two movies in one DVD9 and about half a season of any series. Of course, you know your needs better, that's why the table above explaining all options exists.

How to create a DVD that holds many movies or an entire season of a series using FAVC

At the guide below we will use the freeware tool FAVC to create a DVD that will hold five movies, which in this example means about 8 hours and 45 minutes of video and an approximate bitrate of 1100kbps (more on less like the first sample in the table above). I decided to bad credit loans use FAVC as it comes with both the encoders I mentioned above, lets you add subtitles per track and creates a menu. It is also pretty easy to use. Note that while other encoders like ConvertXToDVD are much faster and feature full, for such low bitrate the quality of the video is much worse than what we will create with this tool. Don't worry about the many options, they are very simple and we will explain everything you need. First of all browse (1) and load the files you want to add in the DVD. Most of the video types (avi, mkv, mp4) are supported by FAVC. Next set the locations for the destination folder (2) and the temp files folder (3). Make sure you have enough free space! If you want, FAVC can also create an ISO file (4) for easier burning, otherwise it will create just the DVD files you can burn by following our guides.
Select the DVD format (5) between NTSC and PAL, obviously depending on your equipment. Now set the target size (6) between a normal DVD and a dual layer one. Note that to burn a dual layer DVD you need a DVD9 disc and a burner capable of burning it, so make sure you can in fact burn such a disc. Chapter length (7) sets every how many minutes a chapter will be created (used to navigate though the movie with the remote). You would probably want to create a Menu (8) in order to easily select which movie you want to see. Note that you cannot have a menu if you add more than 10 videos (for example 20+ episodes of a TV show), for some reason FAVC limits the menu creation to up to 10 tracks. In that case this option will be disabled and you can select the episode to play with the Next Track button in your remote control.
At the Encoder (9) option, my choice is HC. In my unsecured loans opinion, it creates better looking video than QuEnc, especially in lower bitrate. If you want to decide by yourself check the samples in the table above. To continue, click the DVD Options tab and move to the next step.

The first options in these screen are about the menu. First (1) you can set the Title of the menu and then the name of each of the videos that you have included in the disc. Next you can set a background picture of your liking (2). The default one is just a grey background. Finally you can use the notepad icon (3) to add subtitle tracks to any of the movies you have added. The Hard Subtitles option will burn them in the video while by default you can turn them on and off with your remote control or DVD player software.
Click the HC Options tab to move on.

Here we need to change some of the encoding options in order to get as better quality as possible. The options here will greatly increase the encoding time, so feel free to try different settings until you find a quality/speed ratio you like. However for such long videos the optimal options are:
In Method of Encoding (1) select 2-Pass Variable Bitrate. In Quality (2) selecting Best will give the best possible quality but with great expense of time. In CPU Cores (3), if you have a multi core CPU (most new PCs do) choose MultiCoreEnc and set the number of the cores you want to use in order to speed the process significantly. Finally in DC Precision (4) set the value to 10 and click the Audio Options tab.

We will use AC3 as the audio encoding (1) codec. We will also select Encode as usual (2) as we cannot afford to possibly retain the present audio as it would be too big for such a small video bitrate: we need to use as less space as possible for audio. So, choose Aften (3) as the encoder and a bitrate of 128kbps (4). Finally click Generate DVD (5) to start the encoding.

A command line window will now open plus various bad credit loans encoder windows. The main FAVC window doesn't do anything, so feel free to close it. Wait for some hours, depending on your PC speed and the video length and a new DVD will be waiting for you in the destination folder, either in DVD files form or both that plus an ISO file. Nicki Minaj loves the kids, but she's not ready to completely clean up her image for her young fans.
“I've always been kind of racy,” Minaj says, laughing. “Don't expect that to change, but I love children and I respect children so much. ... I'm big on them remaining, you know, kids. I don't want them to go around cursing and acting crazy.”

Many kids — and others — are going out to buy Minaj's sophomore album, “Pink Friday: Roman Reloaded,” which sold 253,000 units in its first week, according to Nielsen SoundScan, giving Minaj her second No. 1 album.
In just three years, the rapper has transformed her image by singing on her songs, and toning down her oversexed appearance. Her fan base now includes young girls, which she says surprised her.
“I didn't expect the kids to gravitate to me like that,” the 29-year-old said in a recent interview. “I'm finding my own niche with them.”
One of the reasons children have connected with Minaj is thanks to pop hits like “Super Bass,” “Turn Me On” with David Guetta and “Starships.” Minaj is also featured twice on Madonna's latest album, “MDNA.”
“Roman Reloaded” showcases Grammy-nominated Minaj as her male alter ego, Roman. The album has multiple sounds to match her multiple personalities: In addition to dance-pop anthems that mirror Rihanna and Katy Perry, there is hard-core hip-hop, contemporary R&B and reggae flavors.
“Once I did it I was like, ‘Why aren't all albums like this? Why does every artist have to give you one thing?'” Minaj asked. “I like going to restaurants because I can order a little bit of salad, a little bit of bread, a little bit of chicken, some sushi. I like variety. I get very, very bored if I have to keep things the same.”
The new album follows her 2010 debut, “Pink Friday,” which is approaching double platinum status and launched seven singles that were hits on the pop, R&B or rap charts. “Roman Reloaded,” which boasts 19 tracks, features Chris Brown, Lil Wayne, Drake and Nas, and producers like RedOne, Dr. Luke, Alex da Kid and J.R. Rotem.

I recently had someone email me regarding my article about the gumtree scam. He was wondering how it could be a scam if you never actually send any money to the advertisers, so I decided to use this post to detail how the scam works exactly.

1. The scam starts by the fraudsters taking pictures of either hotels or celebrity styled houses and then posting it on gumtree for rent.

2. The unsuspecting user is taken in by the pretty pictures, great location and most importantly of all, the cheap price for rent.

3. The user replies the fraudster asking about the flat.

4. The fraudster replies saying he/she is a doctor/engineer/lawyer (whatever) and is currently outside the country and needs to know you are serious before he/she comes down to show you the house.

5. The fraudster later says in order to know if you are serious and if you have the money, you should wire two months rent to a friend, partner or someone close to you and then scan the receipt and send it to him. Once he calls to confirm the funds are actually there, he will come down, show you the house and you can withdraw the money from western union and pay him.


Pay close attention to the fifth point as this forms the heart of the scam. If you decide to send the money to your friend and you scan and send him the receipt, forget about getting your money back. The receipt you would have sent him will have all the information necessary to withdraw all the money. Once he/she gets that, they will probably create a fake ID, go to the western unsecured loans union shop, pretend to be the recipient of the funds. Since they WILL have the reference numbers and any additional information needed from the receipt, they WILL be able to withdraw the funds, leaving you with no money and a pretty picture of the flat you just paid for.

Do Cats Even Like Them?

Basically, this just has a bright spot moving around the screen. Not surprisingly, most cats gave it a ho-hum. Paint for Cats got a better response. This app has a little brown mouse darting around the screen; when kitty's paw tries to pin it, the iPad registers a colorful finger-paint impression. Rembrandt, it's not. But maybe Van Gogh in his later years

Next, I tried Cat Fishing 2. This one got the best response, as several cats were enticed to pounce on the colorful fish swimming across the screen.
Finally, what Friskies is calling the first inter-species bad credit loans game: You vs. Cat. This is set up something like air hockey, where you (the human) send a virtual cat treat bouncing across the tablet. If you get it into the goal before your cat pounces on it, you score; if not, your cat scores. Clever idea, and definitely a fun way to interact with your pet — if she wants to play.

The fun would end in a flash if kitty's claws scratched the screen. Good news, here. I spent the day letting half a dozen cats go at my iPad — one even liked to bite the home button — but the device escaped unharmed.

Does Your Cat Really Need an iPad?
True, your cat will not be developmentally stilted or shunned by its peers if it doesn't have the latest apps and an iPad, but if you have a particularly curious cat, this could offer some variety.  Yet even the cats that liked the apps the most still liked physical toys and a real laser pointer better.

A lobotomy?


A lobotomy was once thought to cure everything from schizophrenia and depression to anxiety and moodiness. It also may have been used on patients who had chronic pain from headaches or backaches that could be cured no other way. An alternative name for this psychosurgery is leucotomy, meaning "slice/cut white" in Greek.

There were a few ways to perform psychosurgery that generally involved drilling holes into the patient's skull so that the doctor could access their brains. unsecured loans Once this was done, he might use a leucotome, which was a pencil-sized tool, to sever nerves through holes at the top of the skull. In fact, Freeman became a huge advocate for the procedures and performed transorbital lobotomies on an estimated 2,500 people in 23 states before he died in 1972 . Freeman touted that the procedure cut away the emotions in the brain that caused mental illness; with the transorbital method, he could complete the procedure in just 10 minutes. The procedure had successes but also tragic results. His final operation caused a brain hemorrhage in a housewife and his career ended in about 1967.

Titanic DOOM

The Titanic may have struck an iceberg and sank helplessly because of a strange atmosphere-caused optical illusion, a new book argues. British historian Tim Maltin says super refraction, an extraordinary bending of light that causes mirages, prevented the Titanic’s crew from seeing the fateful iceberg.
It also may have prevented nearby ships from seeing the doomed Titanic, Maltin argues. His theory is the subject of a new book and a documentary airing next month in time for the 100th anniversary of the accident.

Apparently a British investigation in the 1990s brought up super refraction, but no one ever studied it in depth, according to Smithsonian magazine, bad credit loans which just published an excerpt from Maltin’s new book. Maltin studied old weather records, shipping logs and survivor testimonies to determine the atmospheric conditions on April 15, 1912. He argues conditions were ripe for super refraction, caused by a thermal inversion in the area south of Newfoundland were the ship was sailing. This abnormal bending of light waves would have created a false horizon, and the iceberg lay beneath it, out of view of the ship’s lookouts.

Porn Star Prom Date


OAKDALE, Minn. (FOX 9) - We hear it in the news all the time -- people asking celebrities to dances or fundraisers. The same is true for one Oakdale, Minnesota teen looking for a date to his high school prom.
His choice? An adult film actress.

Michael Stone used Twitter to ask just about every porn star he could think of to help him out. After around 600 tweets, he got a date.

The lucky lady is Megan Piper, who accepted on the condition Stone covers her travel costs from Los Angeles. So now the 18-year-old is on a mission to raise $400 to get his date a plane ticket to Minnesota for the Tartan High School prom on May 12.

Piper, 19, says she was not able to attend her unsecured loans own senior prom and was excited about the possibility.

Perhaps by now you’ve heard about the trouble Invisible Children founder Jason Russell found himself in last week: Amidst all the controversy and criticism surrounding his “Kony 2012″ video, Russell was detained on Friday, after witnesses spotted him naked and masturbating on a street corner in downtown San Diego in the middle of the day.

Russell was taken into custody and placed in an involuntary 5150 mental health hold (the same one Britney Spears was placed in) after several callers reported him dancing and pounding his fists on the ground, beating on cars, screaming and yelling incoherently. No charges have been filed against him.
Given the spate of criticism and discussion around Invisible Children and the KONY campaign, we thought we’d see what we could find out about Russell himself.

1. Invisible Children is thus far standing behind him. On Friday, after word of his arrest spread, they released the following statement:
“Jason Russell was unfortunately hospitalized yesterday suffering from exhaustion, dehydration, and malnutrition. He is now receiving medical care and is focused on getting better. The past two weeks have taken a severe emotional toll on all of us, Jason especially, and that toll manifested itself in an unfortunate incident yesterday. Jason’s passion and his work have done so much to help so many, and we are devastated to see him dealing with this personal health issue. We will always love and support Jason, and we ask that you give his entire family privacy during this difficult time.”
2. His wife Danica Russell is standing behind him, too. She claims he has “never had a substance abuse or drinking problem, and this episode wasn’t caused bad credit loans by either of those things. … Because of how personal the film is, many of the attacks against it were also very personal and Jason took them very hard,” she said in a statement.

3. Interflora v M&S


Yesterday morning, the Court of Justice of the European Union (CJEU) delivered its eagerly awaited ruling on questions referred by the High Court in relation to the keyword advertising dispute between Interflora and M&S.



Brand owners (particularly those with a reputation) are likely to be happy with the decision, which opens up new lines of attack against competitors bidding on their trade marks as keywords.  However, advertisers need not be too disheartened:  though the door may have opened a little further for these types of claims, the CJEU has taken care not to let it swing open too widely.

In the High Court, Interflora, the world’s largest flower delivery network, claimed that M&S was infringing its registered trade marks by purchasing several keywords containing the mark INTERFLORA. Consumers searching on the internet using these keywords would be directed to a sponsored link to M&S’s online flower-delivery service.  Questions were referred to the CJEU to determine whether Interflora could prevent M&S from using Interflora as a keyword even though it did not appear in the sponsored link, and whether M&S’s actions took unfair advantage of Interflora’s reputation and diluted its distinctive brand.

The CJEU’s judgment builds on the foundations laid down in the Google France decision, which focused on whether keyword advertising will have an adverse effect on the ability of the trade mark to act as a badge of origin.  Applying this test in Interflora, the CJEU said that the High Court will need to establish whether the reasonably well informed internet user is deemed to be aware, on the basis of general knowledge of the market, that M&S is not part of Interflora’s network.

The CJEU then extended the Article 5(1)(a) test set out in Google France, meaning that brand owners will now be able to argue infringement where the use of a trade mark as a keyword “substantially interferes with the proprietor’s use of its trade mark to acquire or preserve a reputation capable of attracting consumers and retaining their loyalty” (described as the mark’s “investment” function). 

However, the CJEU has not made it easy for Interflora, stating that neither a switch of “some consumers” to M&S (prompted by the sponsored link), nor evidence that Interflora has unsecured loans had to adapt its efforts to maintain the reputation will be sufficient to show that the investment function has been adversely affected.  So what will be sufficient?  How is a trade mark owner to demonstrate an adverse effect on the investment function?  It will be interesting to see Interflora’s position on this when the case returns to the High Court.

The CJEU has also said that Article 5(2) applies in “double identity” cases, thereby paving the way for claims that keyword advertising takes unfair advantage of the reputation of a trade mark, and/or dilutes its distinctive character, and/or tarnishes its reputation.  Interestingly (although perhaps not surprisingly), the question of whether internet users can easily tell whether the advert is that of the competitor and not that of the trade mark owner or an economically bad credit loans linked undertaking (i.e. the Google Francetest) will be relevant in assessing whether there is unfair advantage or dilution.  In broad terms, if internet users are not confused as to the origin of the advert, this could satisfy the “due cause” test, leaving the competitor better placed to resist a challenge of infringement under Article 5(2).

On the face of it, the judgment appears to give brand owners more ammunition in their locker to aim at their competitors in the context of keyword advertising.  However, in practice the fact that the Google Francetest may make or break other elements of the claim means that brand owners’ rights may not have been extended as far as it first appears.  

It remains extremely important for advertisers bidding on trade marks as keywords to make clear to the informed internet user that their advertisement does not originate from the trade mark owner or an economically linked undertaking.  Advertisers should review their keyword advertising strategy in the light of the CJEU decision, but do not need to dive for cover just yet.

Charles Bronson


Death Wish 4 provides Charles Bronson with employment in his customary line of work: He loads himself down with ammunition and sets out to do justice in the world, without the intermediary of the judicial system. This time out, the target is drugs. Since, as one character puts it, “Everybody does drugs these days,” Bronson has quite a task.
As the film opens, it looks as though Bronson is preparing to ease into his golden years. He’s got a new girlfriend (Kay Lenz) and a flourishing business as an architect. Lenz has an adolescent daughter who is perky and lovable and full of life. This means that she is, of course, marked for death, since most people who get close to Bronson in these movies wind up getting wasted.
He takes revenge on the pusher who sold her some deadly drugs. Then Bronson is hired by a rich newspaper man (John P. Ryan) who seeks to destroy the two main suppliers unsecured loans of drugs in Los Angeles. Bronson opens up the ammo arsenal that he keeps behind his refrigerator and goes to work.
It’s formula action, although this sequel is slightly better than the last two Death Wish movies. J. Lee Thompson brings at least some professionalism to his direction, though the movie never blinds you with its speed. Bronson, who looks more than ever like a large, grizzled otter, goes through his usual paces. He begins the film with a dream about his favorite haunt, a dimly lit parking garage, and he remains all but asleep throughout the rest of the movie.

A crap remake of Bronson’s Mechanic opens this week, so it seemed time to drag out another of that fine star’s desultory outings from the Eighties. And yes, if memory serves, this one was marginally superior to the previous sequels in the series; but J. Lee Thompson would stick with Charlie B. for two subsequent pictures, Messenger of Death and Kinjite—Forbidden Subjects, which were really grueling and ugly. And that was it for the directing career of the man who made The Guns of Navarone and Cape Fear. I don’t need to tell you that Kay Lenz was a mainstay of Seventies and Eighties TV, and played the lead in Clint Eastwood’s Breezy, a nice bad credit loans movie that had an incredibly maddening and unavoidable four-wall ad campaign. (I wasn’t old enough to go to the movie when it came out, but logging twelve hours of television a day, the commercials would drive you insane.) It was the kind of thing to make you never forget Kay Lenz.

The Walking Dead mega shocker!!!

Last night was the second to last episode of AMC's hit show "The Walking Dead."  Seriously, this show is so popular that it has a half hour show devoted to talking about it.  This season will have a total of thirteen episodes, which is a vast expansion from the six that the first season features.  Once again, fans will have to wait till October to see their favorite zombie apocalypse survivors in action again.
The show has remained relatively faithful to the comic, keeping most of the important characters and plot points (the CDC explosion in the finale of season one was a deviation).  Perhaps the reason for this is that Robert Kirkman is a driving force behind both of them.  One event unsecured loans that I have been looking forward to, but that was different in the show than in the comic, was Shane's death.  I have been against Shane ever since I read in the comic that he started a relationship with Lori.  Even if he honestly thought Rick was dead, sex is not something that should be on your mind in a zombie apocalypse.  The relationship stops when Rick miraculously comes out of his coma, and ends up finding the group that Lori, Shane, and Rick's son Carl are a part of.  In the show, Shane slowly starts to go crazy after Rick's return, and especially after he finds out that Lori is pregnant.  I personally think the baby is his, but he keeps pestering her about it and about them being a "family," despite her repeated talks with him about how there is nothing between them.
At the start of the episode, Shane sneaks into the barn, bad credit loans presumably to mess with or torture Randall, who the group has been keeping captive.  We are shown glimpses of Shane's inner thoughts, which are definitely the inner thoughts of a crazy person.  He ends up killing Randall and pretending that Randall attacked him and ran into the woods.  Thus a majority of the men in the group split into small groups and go searching for Randall.  Rick and Shane are teamed up, and they end up in the meadow just outside the barn's fence, where Shane pulls his gun on Rick.  He goes on about how much better he is in every respect than Rick, and when Rick refuses to pull his gun on him, Shane lunges at him.  He shoots, but it misses and Rick stabs him in the heart, killing him.
Carl arrives shortly after, and clearly sees that Rick killed Shane.  Meanwhile, we are being shown intermittent clips of zombie mouths and faces, with gruesome zombie noises.  Carl raises his gun, seemingly at Rick, but then shoots Shane, who has risen back up as a zombie, or walker as the series calls them.  The episode ends with a horde of zombies running out of the woods, and Rick and Carl hauling it back to the barn, to get ready for the big showdown in the season finale.  See you then!

kate middleton preggers?


LONDON – Just five days into her marriage with Prince William – Kate Middleton announced that she is pregnant!
Kate Middleton is pregnant with Prince William’s first child.   The announcement was made by Kate with her friend Victoria Beckham standing at her side.
Beckham reportedly encouraged Kate to have a baby as soon as possible because “it is   one of the best things in the world.”
Royal insiders believed that Kate would get pregnant within the first year of her marriage to Prince William, but everyone was surprised at how fast it happened.
“Prince William and Princess Kate spent over fifteen hours in the Royal Wedding Suite,” said Royal butler, Thomas Hillstrom.  “They spent quite a lot of time ‘enjoying’ each other’s company.”
Many in England are now speculating that Kate was pregnant at the time of the wedding, but Royal gynecologist, Dr. Fritz Barnwell, said “Kate was not pregnant last Friday, unsecured loans the Queen had us test her to ensure that she was without child.  But today, at Prince William’s request, we performed advanced pregnancy tests on Kate and we can confirm, decidedly, that she is five days pregnant.”
Queen Elizabeth is thrilled to learn that she will have her first great-grandchild.  Prince Charles, however, is not so happy.  “What’s the point of having a baby, when the world is about to burn up.  We must all stop using fossil fuels, we must kill all the cows, and we must plant as many trees as possible,” Prince Charles said before getting onto his private jet in Los Angeles with twenty-five members of his staff.
Princess Kate said that she and Prince William will continue to bad credit loans enjoy each other’s “company” in the Royal Wedding Suite, even though she has already made Her Majesty happy with her pregnancy.  “Prince William is a Royal stud. That’s all I can say.”
The happy couple has not been seen for the last ten hours – but there’s been a lot of moaning coming from the Royal Suite.
